LIVING TAPESTRIES STANDARD WARRANTY

 

 1.  EXTENSION AND SCOPE OF LIMITED WARRANTY.

Living Tapestries warrants to the purchaser of its Fence That Grows, parts and accessories that such goods are free from defects and omissions in material and workmanship as delivered in unassembled and unaltered form.

 2.  LIMITATIONS AND DISCLAIMER.

LIVING TAPESTRIES WARRANTS THAT ITS VINYL PLASTIC MATERIALS WILL BE FREE FROM PROBLEMS CAUSED BY THE EFFECTS OF SUNLIGHT FOR FIFTEEN YEARS FROM THE DELIVERY OF THE UNASSEMBLED GOODS TO THE ORIGINAL PURCHASER OR DEALER.  LIVING TAPESTRIES LIMITS ALL OTHER WARRANTIES ON ALL OTHER GOODS TO ONE YEAR AFTER THE DELIVERY OF THE UNASSEMBLED GOODS OF THE ORIGINAL PURCHASER OR DEALER.  (Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.)

LIVING TAPESTRIES MAKES NO WARRANTY OF ANY KIND, STATUTORY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF OR ANY OTHER WARRANTY EXCEPT FOR THE LIMITED WARRANTY PROVIDED ABOVE.  OTHER THAN SUCH WARRANTY PURCHASER ACCEPTS THESE GOODS “AS IS.”  LIVING TAPESTRIES SHALL NOT BE LIABLE TO THE PURCHASER OR USERS OF THESE GOODS FOR ORDINARY NEGLIGENCE OR ANY OTHER ACT OR OMISSION.  LIVING TAPESTRIES SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY CONSEQUENTIAL, SPECIAL, CONTINGENT OR INCIDENTAL DAMAGES IN ANY WAY RELATED TO THE MANUFACTURE, DESIGN, SALE, DELIVERY, INSTALLATION, REPAIR, ALTERATION OR USE OF ANY GOODS SOLD TO THE PURCHASER.  (Some states do not allow the exclusion of limitations of incidental or consequential damages, so the above limitation may not apply to you.)

 3.  LIVING TAPESTRIES RESPONSIBILITIES.

The obligation of Living Tapestries under this warranty is limited to repair or replacement of any defective materials at Living Tapestries option and at Living Tapestries manufacturing place of business, with all shipping and related expenses paid by the purchaser.

 4.  OTHER TERMS

Living Tapestries does not assure or authorize any other party to assume any liability for Living Tapestries in connection with its goods other than the expressed  above.  This document constitutes the entire obligation of Living Tapestries and is the  agreement of the parties with respect to the warranty provided herein.
